About Us

Pendente lite alimony is temporary support awarded to a spouse while the litigation is pending. Unlike rehabilitative and permanent alimony only a few of the twelve factors are considered when awarding pendente lite alimony. Therefore, a pendete lite alimony hearing is usually more abbreviated and only the following factors are considered:

(1) The needs of the person seeking alimony compared to the ability of the person paying the alimony

(2) The standard of living of each party. This factor takes into account the kind of lifestyle to which the spouse seeking alimony has been accustomed.

(3) Various income/ability to pay issues:

(a) The payor’s or recipient’s full-time work status

(b) Whether either party has voluntarily impoverished themselves

(c) Ability to pay evidenced by previously made payments
