Factors Regarding Emergency Family Maintenance Awards
“Emergency family maintenance” (EFM) is a monetary award granted to a person eligible for relief, and to whom an abuser owes a duty of support, based on two factors. EFM is a hybrid of alimony and child support and is used for the support of both a spouse and children. A pendente lite award for alimony or child support supersedes an EFM award.
The EFM factors, which must be weighed prior to an award of emergency family maintenance, include the following:
(1) The financial needs of the person eligible for relief
(2) The resources available to the person eligible for relief and the abuser
A party to a divorce proceeding can consolidate the protective order case with the divorce action and request back EFM as part of the divorce action.
